Court passes judgment on security guard of General Rail Rzayev’s apartment

Yasamal district court held a hearing on the case of Elshan Eyvazov, security guard of the building, where assassinated Air Force and Air Defense Commander Lieutenant-General Rail Rzayev had lived.

13:47 / 03.02.2010 APA reports that Fuad Talishinski presided over the hearing.The defendant’s lawyer Khalid Rzayev addressed the court. He said Elshan Eyvazov was held accountable in connection with General Rail Rzayev’s assassination in February last year.
“On February 17, he was sentenced to 10 days in jail. Elshan was held at the detention facility of the Interior Ministry’s Department to Combat Organized Crimes. They said he resisted to the police when he was detained near Nizami metro station,” he said.

The lawyer said his client had undergone torture at the Department to Combat Organized Crimes. The lawyer asked the court to acquit Eyvazov.

Eyvazov said all the accusations were groundless and asked the judge to pass a fair decision.

The court announced the decision after the advisement. The judge said the charge under article 320.1 had been lifted. The court sentenced Eyvazov to 3 years and 6 months in jail.

The public prosecutor had demanded 5-year imprisonment for the defendant.

Elshan Eyvazov faced charges under articles 234.1, 320.1, 178.2.4 of the Criminal Code. He is accused of counterfeiting documents to get targeted social assistance in May, 2006. According to the indictment, opium was found in Eyvazov’s car.

Elshan Eyvazov had worked for three years as security guard in the building where Rail Rzayev had lived. Eyvazov had been on duty by the time Rail Rzayev was killed on February 11, 2009. On February 17, Yasamal district police detained Eyvazov. He was interrogated in the Department for Grave Crimes of the General Prosecutor’s Office.

Air Force and Air Defense Commander Lieutenant-General Rail Rzayev was assassinated on February 11, 2009. General Prosecutor’s Office, Interior Ministry and National Security Ministry set up a group to investigate the assassination.
